Please read these Terms and Conditions ("Agreement") carefully before purchasing any artwork through my website. This Agreement sets forth the legally binding terms and conditions for all art sales conducted through our website or any related application.

 

1. Acceptance of Terms

By accessing the website and making a purchase, you acknowledge and agree to be bound by the following terms and conditions.

 

2. Product Descriptions 

We strive to provide accurate and detailed descriptions of the artwork available for sale. However, please note that colours, dimensions and other features may vary slightly from the actual product due to monitor settings and artistic variations.

 

3. Pricing & Payments

All prices displayed on our website are in GBP (Great British Pound). Payment must be made in full at the time of purchase using one of the payment methods as specified on the website. The payments through the website will be handled through Stripe. 

 

4. Ordering & Acceptance

By placing an order, you make an offer to purchase the selected artwork. We reserve the right to accept or decline your offer and is our sole discretion. Upon receipt of your order, we will send an order confirmation via email, which does not constitute a legally binding contract. In the event that we are unable to fulfill your order, we will notify you and provide a refund if payment has already been made.

 

5. Shipping & Delivery

We will make reasonable efforts to ensure that the artwork is appropriately packaged and shipped to the address provided during the ordering process. Shipping costs and any additional charges will be clearly indicated before finalising your purchase. Orders should be dispatched within two weeks of purchase, when we will send a dispatch confirmation via email, and should be delivered within 48 hours. Please note that delivery times are estimates and may be subject to unforeseen delays.

 

6. Returns & Refunds

When receiving your order, if you discover the artwork to be damaged please advise by completing the Contact Form, and return the artwork immediately. Upon receipt of the item(s) a full refund will be issued or replacement(s) sent. 

You also have the right to cancel your order and return the artwork within 14 days from the date of delivery, provided it is in its original pristine condition and packaging. Please notify us of your intention to cancel by completing the Contact form. You are responsible for the return shipping costs and once the artwork is received and inspected a refund will be issued excluding the original postage costs incurred by ourselves.

 

7. Intellectual Property

All intellectual property rights, including copyrights and trademarks, related to the artwork, images, and content on our website, are the property of Ian Smith. You may not reproduce, distribute, modify, or use any of the intellectual property without obtaining the appropriate permissions or licences.

 

8. Privacy & Data Protection 

We are committed to protecting your privacy and handling your personal information in accordance with applicable data protection laws. Please review our Privacy Policy to understand how we collect, use and store your data.

 

 9. Limitation of Liability

To the extent permitted by law we shall not be liable for any indirect, consequential, or incidental damages arising out of or in connection with the purchase, use, or display of the artwork, including but not limited to loss of profits, data, or reputation.

 

10. Dispute Resolution and Jurisdiction

Any disputes arising from these terms and conditions or the purchase of artwork shall be resolved through good-faith negotiations. If an agreement cannot be reached, both parties agree to submit to the exclusive jurisdiction of the courts.

 

11. Termination

We reserve the right to terminate or suspend your access to our website and services, without prior notice, in the event of a breach of these terms and conditions or any applicable laws or regulations.

 

12. Modifications

We reserve the rights to update or modify these terms and conditions at any time without prior notice. Any changes will be effective immediately upon postings on our website. It is your responsibility to review the terms and conditions periodically.
